This website located at the URL of www.charityvillage.com (the “Site”) is owned and controlled by Charity Village Limited (“CharityVillage”), a company incorporated under the laws of the province of Ontario in the country of Canada. CharityVillage knows that protecting the privacy and confidentiality of your Personal Information (“Personal Information”) is of paramount importance. CharityVillage is committed to maintaining the accuracy, confidentiality and security of your Personal Information. We have developed this Privacy Policy to describe our privacy policies and practices and how we collect, use and disclose the Personal Information of those individuals who visit our Site. This privacy policy (the “Privacy Policy”) explains what Personal Information is collected from users of the Site and how it is used. It also explains how you can ask questions, make suggestions, and complain about our privacy practices. This Privacy Policy applies to Personal Information (as more specifically defined below) collected by CharityVillage. Privacy Policy Effective for Canada
It is CharityVillage's policy to comply with the privacy legislation within each jurisdiction in which CharityVillage operates. Although this Site can be accessed from anywhere in the world via the Internet, CharityVillage’s business activities are limited to Canada. Sometimes the privacy legislation and/or an individual's right to privacy are different from one jurisdiction to another. This Privacy Policy covers only those activities that are subject to the provisions of Canada's federal and provincial privacy laws, as applicable. Collection, use, storage, retention, disclosure and destruction of Personal Information by CharityVillage is governed by the Personal Information Protection and Electronic Documents Act (the “Act“), and any applicable provincial legislation.
This Privacy Policy has a limited scope and application. Consequently, the rights and obligations contained in this Privacy Policy may not be available to all individuals or in all jurisdictions. What is Personal Information?
For the purposes of this Privacy Policy, Personal Information is any information about an identifiable individual, other than the person's business title or business contact information when used or disclosed for the purpose of business communications.
The Privacy Policy does not impose any limits on the collection, use or disclosure of the following information by CharityVillage: a) information that is publicly available, such as a Person’s name, address, telephone number and electronic address, when listed in a directory or made available through directory assistance; b) business-contact information, such as the name, title or business address or telephone number of an employee of an organization; c) information shared publicly by a person in their user profile, such as work or educational history, social media contacts, and other profile information; d) public information collected, used or disclosed in the course of journalistic activities; or e) aggregate information that cannot be associated with a specific person, such as demographic statistics about CharityVillage customers, or number of visitors and average time spent on a website.
General: What Personal Information Does CharityVillage Collect?
You can visit the Site without telling CharityVillage who you are or revealing any information about yourself, including your e-mail address. CharityVillage's web server may collect information related to your visit to the Site, including the IP address and domain used to access the Site, the type and version of your browser, the website you came from to access the Site, the page you entered and exited at, any website page that is viewed by that IP address and what country you are from. CharityVillage uses this information to monitor the Site's performance (such as number of visits, average time spent, page views) and for CharityVillage's business purposes, such as working to continually upgrade our Site.
CharityVillage collects and maintains different types of Personal Information in respect of the individuals with whom CharityVillage interacts. This includes contact and identification information, such as your name, address, telephone number and e-mail address, and any other contact or other information that you choose to provide by:
using the "contact us" portion of this Site;
applying for a position through this Site;
registering for a service provided through this Site
by corresponding with a representative of CharityVillage via e-mail using the hyperlinks created for that purpose.
Where you request information from CharityVillage, CharityVillage may use the contact information that you provide to send you information about offers on products and services that CharityVillage provides to, or receives from, you, or that CharityVillage believes may be of interest to you. CharityVillage may also contact you to provide you with, or collect from you, business relationship information, including information related to your agreements, preferences, advisors and decision-makers, feed-back and other information requested by or provided to you.
If you have asked CharityVillage to put you on an e-mail mailing list, CharityVillage may e-mail you our newsletter. Each of CharityVillage's newsletter e-mails includes an unsubscribe link that you can use to remove yourself from such mailing lists.
CharityVillage may also collect market-related information, which may include Personal Information, concerning market trends and activities impacting CharityVillage's business. This information may include contract terms, financial information and other information for the purpose of market analysis and strategic planning. CharityVillage may also collect information related to CharityVillage media and public relations activities and information related to CharityVillage's interactions with financial and other consultants and advisors.
As a general rule, CharityVillage collects Personal Information directly from you. In most circumstances where the Personal Information that CharityVillage collects about you is held by a third party, CharityVillage will obtain your permission before CharityVillage seeks out this information from such sources (such permission may be given directly by you or implied from your actions).
From time to time, CharityVillage may use the services of third parties in CharityVillage's business and may also receive Personal Information collected by those third parties in the course of the performance of their services for CharityVillage, or you, or otherwise. Where this is the case, CharityVillage will take reasonable steps to ensure that such third parties have represented to CharityVillage that they have the right to disclose your Personal Information to CharityVillage.
Where permitted or required by applicable law or regulatory requirements, CharityVillage may collect information about you without your knowledge or consent.
Specific Users - What Personal Information Does CharityVillage Collect?
There are six main classes of users who may access the Site and the information we collect about each one is different:
Visitors– Visitors to the Site may visit various pages on our Site to learn more about the services we offer and explore other information we publish on our Site, including newsletter, videos and webinars. We do not collect any Personal Information from visitors to the Site until they specifically decide to sign up for certain products or services we offer, the type of which are defined below.
Webinar Attendees & eLearners – As a user of Webinars you will have to provide basic contact information to register (name, postal code and email address). As a user of our eLearner services, you will need to provide your basic contact information to use the services (name, postal code and email address) unless the purchaser of the service is an organization who registers on behalf of its employees, in which case full billing information is required. If any of the services you wish to access are paid services, we will require your credit card details to process the payments or your contact information for invoicing depending on the purchase price.
Purchasers – As a purchaser of one of the products or services which CharityVillage offers to Visitors from time to time, including but not limited to subscriptions for various services, we will require your name, email address, and credit card details to process the payments or your contact information for invoicing, depending on the purchase price and nature of the transaction.
Job Poster – As an employer who wishes to post job opportunities on the Site, you will need to supply your basic contact information when you sign up to use the service (name, email address and organization). If you decide to use any of our paid services, we will require credit card details to process the payments for these services or your contact information for invoicing, depending on the purchase price and nature of the transaction.
Job Seeker – There is no charge for Job Seekers, so we will not require any information relevant to payment such as credit card details. However, as a job seeker you will need to supply your basic contact information when you sign up for the service (name, postal code and email address). If you subsequently either apply for a job and/or create a profile you will be required to enter information to complete your application or profile which may include Personal Information.
Volunteer Postings & Volunteers – There is no charge for posting event or volunteer positions or for volunteering, so there is no payment information required. However, the Organization posting the Volunteer position or Event listing will have to submit basic contact information when you sign up to use the service (name, email address and organization) and details about the position. As a Volunteer, you will need to supply your basic contact information when you sign up for the service (name, postal code and email address). If you subsequently apply for the volunteer position you may be required to enter Personal Information to complete your application.
If your use of the Site requires the collection of your Personal Information by us, the terms and conditions of this Privacy Policy will apply. If you use our Site to apply for a volunteer or job position posted by a third-party organization, you acknowledge and agree that the Personal Information you provide to apply for the opportunity will be collected and stored by the organization that posted the position. CharityVillage cannot and will not assume any responsibility for the privacy practices, policies or actions of the third-party organizations that post volunteer or job positions on the Site. Under no circumstances is CharityVillage responsible for how such third parties collect, use or disclose your Personal Information. Under no circumstances shall CharityVillage be liable for any damages whatsoever, direct, indirect, incidental, consequential, special or indirect, resulting from your disclosure of Personal Information to a third-party organization in any application for a volunteer or job position posted on our Site. It is your responsibility to, and we strongly recommend that you, review the privacy policies of any such organization before providing them with your Personal Information.
Why Does CharityVillage Collect Personal Information?
CharityVillage collects Personal Information to enable CharityVillage to manage, maintain, and develop our business and operations, including:
to establish, maintain and manage CharityVillage's relationship with you so that CharityVillage may provide you with, or receive from you, the products and services that have been requested;
to develop, enhance, market or provide products and services;
to create and maintain CharityVillage's membership and subscriber lists;
to be able to review the products and services that CharityVillage provides to you so that CharityVillage may understand your requirements for CharityVillage's products and services and so that CharityVillage may work to improve such products and services;
to be able to comply with your requests (for example, if you prefer to be contacted at a business, cell or residential telephone number and advise us of your preference, CharityVillage will use this information to contact you at that number);
to protect CharityVillage against error, fraud, theft and damage to our goods and property;
to enable CharityVillage to comply with applicable law or regulatory requirements;
to meet legal or regulatory requirements, including to protect or defend a legal interest, and in connection with an actual or possible CharityVillage corporate re-organization, merger or amalgamation with another entity, or an actual or possible sale of all or a substantial portion of the assets of CharityVillage, provided that the Personal Information disclosed continues to be used by the entity acquiring the information either for evaluation of the possible transaction, or, on completion of any such transaction, for the purposes permitted by this Privacy Policy, and
any other purpose to which you consent.
As examples of the above:
CharityVillage may from time to time use a person’s Personal Information to contact the person about changes, enhancements or similar notices related to CharityVillage products and services;
if a person indicated that he/she was interested in receiving offers or information from CharityVillage or certain of our selected sponsors or advertisers, CharityVillage may send the person materials about products and services that CharityVillage feels may be of interest to the person;
if a Job Poster person enters a contest or other promotion offered on a CharityVillage website, CharityVillage may, under the rules of the promotion, use the person’s name and certain other information to administer the promotion, such as contacting, announcing and promoting the winners of the promotion;
if a person is a Job Poster and wants to use our services to create a job posting CharityVillage may use the Personal Information provided by the Job Poster to create posting, process payments, communicate with Job Poster to provide online assistance and troubleshooting advice and other business communications and services consistent with industry practices, our services and applicable law; and
if a person is a Job Seeker and wants to create a profile on our Website, CharityVillage may use the Personal Information provided by the Job Seeker to communicate with the Job Seeker, organize the profile, and provide the Personal Information to the Job Poster who posted the job posting for which the Job Seeker submitted the Personal Information, and for the other purposes disclosed elsewhere in this Privacy Policy.
How is this information used?
Job Poster: The information we gather from users who have signed up for a Job Poster account allows us to communicate with each Job Poster individually and provide them with the transactional communications necessary for their account. We may additionally use this information to send marketing or other communications unless the Job Poster has opted-out (see below).
Job Seekers: The information we gather from users who have signed up for a job seeker account (“Job Seeker(s)”) will be used to communicate with each Job Seeker individually and provide them with the transactional communications necessary for their account. We may additionally use this information to send marketing or other communications unless the job seeker has opted-out (see below). Additionally, any information the Job Seeker has included in his or her profile or in a specific job application will be made available to the Job Poster who posted the job in order to help that Job Poster to sort and select candidates to create the best shortlist for the position they are looking to fill. If the job seeker has chosen to make their profile “open”, certain aspects of it (resume, experience, education, etc.) will be visible to other Job Posters who may be looking for candidates.
Do you share my information with anyone?
Except as otherwise stated in this Privacy Policy, we do not trade, rent, or share Personal Information with third parties. We will never sell or rent your Personal Information to third parties for their use without your consent. As a Job Seeker who uses our services, you have given your consent to our sharing your Personal Information with the Job Poster who posted the job you are applying for, as well as our third party software service provider whose servers and systems are encrypted to maintain confidentiality and security of data to industry standards and who is contractually bound to protect and maintain your Personal Information in accordance with this Privacy Policy. CharityVillage also uses a third-party company to manage credit card processing. This company is not permitted to store, retain, or use billing information except for the sole purpose of credit card processing on CharityVillage’s behalf, and they are required to maintain the confidentiality of the information we provide to them.
How Does CharityVillage Use and Disclose Your Personal Information?
CharityVillage may use and disclose your Personal Information:
for the purposes described in this Privacy Policy; or
for any additional purposes for which CharityVillage has obtained your consent to use or disclose your Personal Information.
CharityVillage may use or disclose your Personal Information without your knowledge or consent where permitted or required by applicable law to do so.
When Does CharityVillage Use and Disclose Your Personal Information?
The Personal Information CharityVillage collects is used and disclosed for our business purposes, including for those purposes explained in this Privacy Policy and more specifically described below.
CharityVillage may share your Personal Information with CharityVillage's employees, contractors, consultants, affiliates and other parties who require such information to assist CharityVillage with managing our relationship with you.
CharityVillage may disclose your information to third parties as more specifically described below, including:
third parties that provide services to CharityVillage or on CharityVillage's behalf;
third parties that assist CharityVillage in the provision of services to you; and
third parties whose services CharityVillage uses to conduct our business.
To whom does CharityVillage disclose Personal Information and why?
CharityVillage shares some of your Personal Information with third-party service providers for the purpose of delivering to you certain services if you have purchased these services from us. This may involve the delivery or actual services or use of third-party platforms or technology. We provide only as much information to the third-party service providers as is necessary. We will only share Personal Information with a third-party service provider if you register for, or subscribe to, or purchase products or services. Any such third-party service provider that we retain directly is and will continue to be contractually bound to safeguard your Personal Information, not to use it for any purpose other than the delivery of their services and to otherwise comply with all privacy laws. Use of such third-party services, platforms and/or technology by you directly, through redirection from the Website or otherwise, will be subject to such third party service provider’s then current terms and conditions of use and privacy policy. For example, CharityVillage operates the services provided to our clients and customers using technology and software provided by the SaaS provider, Jobiqo, that provides certain information technology and data processing services to CharityVillage so that CharityVillage may operate our business. As result, your Personal Information may be collected, used, processed, stored or disclosed in Canada or the United States of America. In these circumstances, the governments, courts, law enforcement, national security, or regulatory agencies of such other jurisdictions may be able to obtain access to your Personal Information through the laws of the foreign country. If you elect to subscribe to our mailing list, we will send you updates about us, our products and other offerings and those of third-party vendors that we believe may be of interest to you. You may at any time opt out from further receipt of any such e-mail communication. Please note, however, that by unsubscribing, you will no longer receive e-mail notices of changes to our Site’s Terms of Use, terms of sale and/or this Privacy Policy and you will therefore be required to periodically review these to ensure that no changes have been made since your last visit.
CharityVillage may also disclose or share non-personally identifiable information with partners, advertisers, merchants and/or prospective merchants to help explain our business and the effectiveness of our business or for promotional purposes. For example, we may disclose aggregated demographic information which does not include any personally identifiable information.
CharityVillage may transfer your Personal Information to service providers acting on its behalf in order to perform processing and other specialized services, for example, prize fulfillment of our contests, collection of overdue accounts, investigations regarding potential breaches of your obligations, product delivery, or credit card processing. Your Personal Information may be processed and stored outside of the province in which you reside and/or outside of Canada by us, an affiliate or a third party service provider for the purposes set out in this Privacy Policy and, under the laws of these other jurisdictions, in certain circumstances foreign courts, law enforcement agencies or regulatory agencies may be entitled to access your Personal Information.
CharityVillage may disclose your Personal Information to unrelated parties if we find you have violated any stated terms and conditions of use or terms of sale, or if we need to comply with applicable laws and lawful requests made by law enforcement bodies, governmental bodies or other legal and regulatory authorities.
CharityVillage may disclose your Personal Information to parties connected with the contemplated or actual financing, insuring, sale, assignment or other disposal of all or part of our business or assets, including for the purposes of determining whether to proceed or continue with such transaction or business relationship or fulfilling any records or other reporting requirements to such parties. We will require such parties to treat your Personal Information in accordance with this Privacy Policy and to use and disclose it only for the purposes for which it was collected.
Further, your Personal Information may be disclosed:
as permitted or required by applicable law or regulatory requirements;
to comply with valid legal processes such as search warrants, subpoenas or court orders;
as part of CharityVillage's regular reporting activities to its parent and affiliated companies
to protect the rights and property of CharityVillage;
during emergency situations or where necessary to protect the safety of a person or group of persons;
where the Personal Information is publicly available; or
with your consent.
How Does CharityVillage Use Cookies?
When you visit the Site, CharityVillage places a "cookie" on the hard drive of your computer to track your visit. A cookie is a small data file that is transferred to your hard drive through your web browser that can only be read by the website that placed the cookie on your hard drive. The cookie acts as an identification card and allows the Site to identify you and to record your passwords and preferences. The cookie allows CharityVillage to track your visit to the Site so that CharityVillage can better understand your use of the Site so that CharityVillage can customize and tailor the Site to better meet your needs.
The information we gather through use of cookies is used only in the aggregate and not tied to personally identifiable information. For example, we may track the number of visitors to a specific area of our Site or determine which of our services are used most frequently. We do this so we can continually work to improve our Site and ensure that we are providing the content and services that our visitors want to see and use.
Most web browsers are set to accept cookies. We may also share non-personally identifying information in the aggregate with third parties, such as the media, industry observers, potential customers or partners. For example, we may disclose the number of users that have been exposed to, or clicked on, through our Site.
What about Links to Other Websites?
CharityVillage includes links or integrations to third-party services and websites, including without limitation and subject to change from time to time: Jobiqo, CanProTech, FundRazr, Stripe, and Thinkific. The third-party websites may be subject to less stringent privacy standards and are owned and controlled exclusively by third parties not subject to this Privacy Policy. Please review the privacy policies on any external websites to determine their information handling practices. CharityVillage cannot and will not assume any responsibility for the privacy practices, policies or actions of the third parties that operate these websites. Under no circumstances is CharityVillage responsible for how such third parties collect, use or disclose your Personal Information. CharityVillage will not be liable under any circumstances for any damages whatsoever, direct, indirect, incidental, consequential, special or indirect, resulting from any use of any third-party website. It is your responsibility to, and we strongly recommend that you, review the privacy policies of these websites before providing them with your Personal Information.
Your Consent is Important to CharityVillage
It is important to CharityVillage that we collect, use or disclose your Personal Information where CharityVillage has your consent to do so. Depending on the sensitivity of the Personal Information, your consent may be implied, deemed (using an opt-out mechanism) or express. Express consent can be given orally, electronically or in writing. Implied consent is consent that can reasonably be inferred from your action or inaction. If CharityVillage plans to use or disclose your Personal Information for a purpose not previously identified (either in this Privacy Policy or separately), CharityVillage will endeavor to advise you of that purpose before such use or disclosure.
As CharityVillage has described above, CharityVillage may collect, use or disclose your Personal Information without your knowledge or consent where we are permitted or required to do so by applicable law or regulatory requirements.
Choice/Opt-Out
You may change or withdraw your consent at any time, subject to legal or contractual obligations and reasonable notice, by contacting CharityVillage's Privacy Officer at privacy@charityvillage.com. In some circumstances, a change in or withdrawal of consent may severely limit CharityVillage's ability to provide products or services to you. All communications with respect to such withdrawal or variation of consent should be in writing and addressed to CharityVillage's Privacy Officer.
CharityVillage assumes that, unless you advise CharityVillage otherwise, that you have consented to the collection, use and disclosure of your Personal Information as explained in this Privacy Policy.
How is Your Personal Information Protected?
CharityVillage endeavors to maintain physical, technical and procedural safeguards that are appropriate to the sensitivity of the Personal Information in question. These safeguards are designed to prevent your Personal Information from loss and unauthorized access, copying, use, modification or disclosure. We have taken measures to secure your Personal Information and to prevent misuse. For example, we ensure that the system in which we store your personal data is secure. We consistently update and patch our systems, ensuring that potential vulnerabilities are promptly addressed. Our commitment to open standards means we avoid proprietary technology, providing you with transparent and accessible services.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while this Site strives to protect your Personal Information, CharityVillage cannot warrant the security of any information you transmit to CharityVillage, and you do so at your own risk. Once this Site receives your transmission, CharityVillage makes commercially reasonable efforts to ensure its security on CharityVillage's systems.

It is important that the information contained in our records is both accurate and current. If your Personal Information happens to change during the course of our relationship, please keep CharityVillage informed of such changes.

From time to time, CharityVillage may contact you to request an update of your Personal Information. You can also ask to see the Personal Information that CharityVillage holds about you. Please note that any such communication must be in writing.
When requesting access to your Personal Information, please note that CharityVillage may request specific information from you to enable CharityVillage to confirm your identity and right to access, as well as to search for and provide you with the Personal Information that CharityVillage holds about you. CharityVillage may charge you a fee to access your Personal Information; however, CharityVillage will advise you of any fee in advance. If you require assistance in preparing your request, please contact CharityVillage's Privacy Officer. CharityVillage will endeavour to respond to your request in a commercially reasonable time frame.
Your right to access the Personal Information that CharityVillage holds about you is not absolute. There are instances where applicable law or regulatory requirements allow or require CharityVillage to refuse to provide some or all of the Personal Information that we hold about you. In addition, the Personal Information may have been destroyed, erased or made anonymous in accordance with CharityVillage's record retention obligations and practices.
In the event that CharityVillage cannot provide you with access to your Personal Information, CharityVillage will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.

Interpretation of this Privacy Policy
Any interpretation associated with this Privacy Policy will be made by CharityVillage's Privacy Officer. This Privacy Policy includes examples but is not intended to be restricted in its application to such examples, therefore where the word "including" is used, it shall mean "including without limitation."
This Privacy Policy does not impose upon CharityVillage any obligations, or create or confer upon any individual any rights, outside of, or in addition to, those imposed by Canada's federal and provincial privacy laws, as applicable.
